What Is Spousal Maintenance?

Spousal maintenance is a payment that one party to a relationship makes towards their spouse after separation. Spousal maintenance may be agreed between the parties or if no agreement is reached, may be Ordered by the Courts.

A person from a separated De facto relationship may also apply for maintenance payments from their former partner in specific circumstances.

 

Can I get Spousal Maintenance from my former partner?

To determine whether the Court will order Spousal/De facto Maintenance, the Court will consider whether one person is unable to adequately financially support themselves and whether the other person is reasonably able to financially support them.
